Terms of Use
These Terms of Use ("Terms") govern your access to and use of DiskQ ("DiskQ", "the app", "we", "us", or "our"). By downloading, accessing, purchasing, subscribing to, or using DiskQ, you agree to these Terms.
Eligibility
You may use DiskQ only if you are legally allowed to use the app and agree to these Terms. If you use DiskQ on behalf of another person or organization, you confirm that you have authority to do so.
Limited License
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use DiskQ for lawful personal use on Apple devices you own or control. We reserve all rights not expressly granted to you.
App Functionality
DiskQ may include features for scanning accessible media, reviewing photos or videos, saving selected items, moving files to a local recovery folder, protecting files in a local vault, enhancing images, cleaning photo libraries, and managing premium access. Feature availability may depend on device model, iOS version, permissions, subscription status, local storage, Apple services, and third-party services.
No Recovery Guarantee
DiskQ is not a forensic recovery tool and cannot guarantee recovery of permanently deleted, overwritten, corrupted, encrypted, cloud-only, unavailable, restricted, or inaccessible files. Results may vary. Any counts, previews, scan flows, recommendations, or enhancement outputs are informational and may be incomplete, inaccurate, duplicated, unavailable, or unsuitable for your needs.
Your Content and Responsibility
You are solely responsible for the photos, videos, files, folders, PINs, hints, answers, backups, device settings, and other content you create, import, store, edit, move, delete, recover, restore, or share through DiskQ. You must have all rights and permissions needed to use content with the app. Do not use DiskQ for illegal, harmful, infringing, abusive, or unauthorized activity.
Local Storage and Data Loss
Files stored in DiskQ may be kept locally on your device. If you delete files, clear app data, uninstall the app, lose your device, forget your PIN, lose access to your Apple ID, change permissions, run out of storage, or experience device or software failure, your files may be permanently lost. You are responsible for maintaining your own backups.
Subscriptions and Purchases
Premium features may require an Apple in-app purchase or auto-renewable subscription. Prices, durations, trial eligibility, renewal terms, taxes, and cancellation options are shown by Apple before purchase and may vary by country. Subscriptions automatically renew unless canceled according to Apple's rules. You can manage or cancel subscriptions in your Apple ID settings.
Purchases are processed by Apple. Refund requests, billing disputes, payment method issues, and cancellation controls are handled by Apple according to Apple's policies. We may use third-party subscription infrastructure, such as Adapty, to validate purchases and manage access.
Acceptable Use
You agree not to misuse DiskQ, interfere with app functionality, attempt unauthorized access, reverse engineer the app except where legally permitted, bypass payment or entitlement controls, use the app to violate privacy or intellectual property rights, or use the app in a way that may harm us, other users, Apple, third-party services, or any person.
You also agree not to scrape, automate, resell, sublicense, exploit, probe, overload, disrupt, copy, modify, create derivative works from, or use DiskQ for fraud, abuse, malware, harassment, unlawful surveillance, copyright infringement, illegal content handling, sanctions violations, or other unlawful or high-risk activity.
Ownership and Intellectual Property
DiskQ, including its software, interface, design, branding, trademarks, text, workflows, documentation, and underlying technology, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not transfer any ownership rights to you.
Feedback
If you send suggestions, ideas, reviews, bug reports, or other feedback, you grant us a perpetual, worldwide, irrevocable, royalty-free, transferable, and sublicensable right to use that feedback for any lawful purpose without compensation or attribution.
Third-Party Services
DiskQ may rely on Apple services, subscription providers, hosting providers, support tools, or other third-party services. We are not responsible for third-party outages, policies, fees, errors, data handling, availability, or actions. Your use of third-party services may be subject to their own terms and policies.
Disclaimers
DiskQ is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, data preservation, uninterrupted operation, or error-free performance. To the fullest extent permitted by law, you use DiskQ at your own risk.
Limitation of Liability
To the fullest extent permitted by law, DiskQ, its developer, operator, affiliates, service providers, and representatives will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, lost profits, lost revenue, lost data, lost content, device issues, privacy incidents caused by your actions, subscription issues handled by Apple, or any damages arising from your use of or inability to use the app.
To the fullest extent permitted by law, our total liability for any claim related to DiskQ will not exceed the amount you paid for DiskQ during the three months before the event giving rise to the claim, or USD 10 if you paid nothing.
Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless DiskQ, its developer, operator, affiliates, service providers, and representatives from claims, damages, losses, liabilities, costs, and expenses arising from your content, your use of the app, your breach of these Terms, or your violation of law or third-party rights.
Dispute Resolution and Class Waiver
To the fullest extent permitted by law, disputes must be handled individually and not as a class, collective, consolidated, or representative action. Where arbitration, jury trial waiver, venue selection, or class waiver terms are not allowed by mandatory consumer law, those limits apply only to the minimum extent required by that law.
Changes, Suspension, and Termination
We may change, suspend, discontinue, limit, or remove features at any time. We may suspend or terminate access if we believe you violated these Terms, created risk, misused the app, or if required by law, Apple, or a third-party provider.
Apple Terms
Your use of DiskQ is also subject to Apple's applicable App Store terms, Apple Media Services Terms and Conditions, and the standard Apple licensed application terms where applicable. Apple is not responsible for providing maintenance or support for DiskQ except as required by applicable law.
Governing Law
These Terms are governed by applicable laws, without regard to conflict of law rules, except where consumer protection laws in your country require otherwise. Some jurisdictions do not allow certain disclaimers or limitations, so some sections may not apply to you.
Force Majeure
We are not liable for delay, loss, failure, or interruption caused by events beyond our reasonable control, including network failures, platform outages, Apple or third-party service issues, cyberattacks, device failure, natural disasters, labor disputes, war, public emergencies, government action, legal restrictions, or utility failures.
Assignment
We may assign, transfer, or delegate these Terms and related rights or obligations in connection with a merger, acquisition, restructuring, financing, asset sale, legal requirement, or change of control. You may not assign your rights or obligations without our prior written consent.
Severability and No Waiver
If any part of these Terms is found invalid or unenforceable, the remaining parts remain in effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. Rights and remedies are cumulative unless expressly stated otherwise.
Changes to These Terms
We may update these Terms from time to time. The latest version will be posted on this page with an updated date. Continued use of DiskQ after an update means you accept the updated Terms to the extent permitted by law.
